1.Glencar Forests Limited T/A The Irish Oak Renewal Foundation (hereinafter referred to as TIORF) is a Private Limited Company having its registered office at Gortmaloon, Glencar, County Kerry, Ireland. And was set up for the purpose of engaging in the regeneration of Oak Forests in Ireland and to manage Oak woodlands on a commercial basis with a view to realization of profits.

2. TIORF is the owner of lands within Killarney National Park at Gortmaloon, Glencar, County Kerry, Ireland. which is designated as the initial area to be used for this regeneration project.

3. The Party entering into this contract with TIORF will hereinafter be referred to as ''The Purchaser''.

4. It is hereby agreed by TIORF and The Purchaser as follows: -


(a) In consideration of the payment by The Purchaser to TIORF of the sum of €57 EURO or $79.95 US Dollars (subject to currency fluctuations) and the entering into and performance of The Purchasers covenants as set out in paragraph 6 hereunder, TIORF agrees to enter into and perform the covenants set out in paragraph 5 hereunder and

(b) In consideration of the performance by TIORF of the covenants set out in paragraph 5 hereunder, The Purchaser agrees to pay the sum of €57 EURO or $79.95 US Dollars (subject to currency fluctuations) to TIORF and to enter into and perform The Purchasers covenants as set out in paragraph 6 hereunder.

5. COVENANTS BY TIORF

  • 5.1 Plant one Irish Oak tree in a location within TIORF forest at
    Gortmaloon, Glencar, County Kerry, Ireland and

  • 5.2 Furnish to The Purchaser the exact DGPS coordinates (as derived using the Sattelite based Global Positioning System) of the tree planted at (5.1)
    above and

  • 5.3 Furnish to The Purchaser a Certificate of Ownership of The Purchasers
    tree which will contain the exact DGPS location, Date of purchase and
    the Name of the Person as requested on the order form and

  • 5.4 Grant permission to The Purchaser and members of The Purchasers
    immediate family to enter upon the property of TIORF in Glencar for
    the purpose of viewing The Purchasers tree and

  • 5.5 To replace The Purchasers tree in the event of disease or other
    calamitous event. Using the DGPS coordinates the new tree will be
    planted in the same spot or as close as possible. In the event of a change
    of the precise DGPS location a new Certificate of Ownership will be
    issued giving the new DGPS location and

  • 5.6 Maintain and manage the forest at (5.1) above in general terms meaning
    keeping forest pathways clear, dealing with storm damage, fencing, drainage,
    carrying out thinning of the forest as is necessary for the overall health of the
    forest and if this thinning results in The Purchasers tree being felled a new
    tree will be planted and a new Certificate of Ownership will be issued giving
    the new DGPS location and

  • 5.7 Harvesting of The Purchasers tree will only take place when the oak tree
    reaches full maturity, which is expected to be between 150 to 200 years.
    When The Purchasers tree is harvested a new Oak tree will be planted in
    the same DGPS location and

  • 5.8 All proceeds received from forest thinning, harvesting and the sale of
    wood will remain with TIORF as part of its forest management and Oak
    forest renewal program

6. Purchasers Covenants

In consideration of the covenants of TIORF as set out above, The
Purchases hereby covenants to: -

  • 6.1 Pay the sum of €57 EURO or $79.95 US Dollars  (subject to currency fluctuations) to TIORF in the manner as set out in the order form and

  • 6.2 Agree that TIORF shall retain the right to manage The Purchasers tree
    as part of the forest at (5.1) in the manner above as set out in (5.5), (5.6),
    (5.7) and (5.8) above.

7. That any future sale of the forest at (5.1) above will be strictly subject to these
Terms and Condition of Sale and

8. The Terms and Conditions of Sale will come into effect when payment is
received by TIORF and

9. The Law applicable to the Terms and Conditions of Sale shall be the Laws of the Republic of Ireland.
